Transit Organizations Falsely Claiming Ownership of Schedule Data is a Trend

Techdirt is a 12 year old blog which has been the gold standard in investigating government, technology, and legal issues affecting the ability of companies to grow.

Techdirt picked up the story on my fight with MTA, because my story is in no way an anomaly – its a story they’ve seen pop up again and again in Europe and the US.

My fight with MTA is not about MTA’s IP at all – it is about MTA’s falsely claiming ownership to that which is unownable towards extinguishing a small business. I am not the first.

    I thought the issue of whether or not anyone could copyright a collection of data was settled over a decade ago when the Supreme Court ruled that telephone companies could only copyright the format of their phone books, not the data itself. The MTA is on very thin ice on this issue.

    Make no doubt about it, this is purely a case of MTA making legal threats with no merit and asking me “what are you going to do about it?”

    I’m giving them their answer.
